I'm not following it because I'm in the UK and we don't get all this over here... but from your description it sounds like the prosecution are arguing murder and intentionality - the defence will argue manslaughter through negligence and being in a high pressure situation. It will all come down to convincing the jury of his intention to kill or convincing them he was awful and negligent.
