The sixth amendment. You’ve got a right to an impartial jury – whilst it can’t impinge on the free speech of elected officials, there’s an argument to suggest if a senior political figure said ‘if you don’t decide guilty, I’m going to send the army to your houses and arrest your family’ even as a joke, a lawyer would be able to argue the jury wasn’t impartial – that’s what’s going on here.

Maxine waters has some political influence that puts her above just the average citizen – so an appeal about the fairness of the trial can be made. Her comments weren’t an incitement to riot, but they were poorly thought through in terms of consequences that might stem from them.
