The UK may already have explored this problem. https://www.bbc.co.uk/news/uk-54435703 - it's a tragic story, but you can see from the investigation that it's a legal non-starter. There are too many variables for the Police and the Courts to realistically convict. An airborne virus is very different from a sexually transmitted disease between two people - the US is a lot more litigious than over here though, so I'd expect to see some court room action from you guys.
