Yeah, it's a huge clusterfuck - and the right to an abortion should never have been based on the 14th Amendment and due process; it was a weak legal argument. That's been causing a whole host of trouble for a long while now - it should instead have been argued under sexual equality and/or freedom of religious expression.

That aside, it is a worrying direction for the US to take its privacy laws. Here's a more comprehensive version of that answer in article form.
